END USER SOFTWARE LICENSE AGREEMENT

This end user software license agreement is between you, the end user ("USER") and Green Bird Software (hereafter "GBS"), regarding The UML Designer ("SOFTWARE"). This software end user license agreement ("EULA") is a legal agreement. Read it carefully before deciding to use the software. By downloading or installing the software, you are confirming your acceptance of the software and agreeing to be bound by the terms and conditions of this agreement. If you do not agree to be bound by these terms, then you must uninstall the software from your computer and not use it.

I. GRANT OF LICENSE

1. GBS grants USER a non-exclusive license to install and use this SOFTWARE for its intended stated purpose.

2. You acknowledge that no title to the intellectual property in the SOFTWARE is transferred to you. You further acknowledge that title and full ownership rights to the SOFTWARE will remain the exclusive property of GBS and you will not acquire any rights to the SOFTWARE except for usage as expressly set forth in this license.

II. LICENSE RESTRICTIONS

1. You may distribute the binary redistributable setup package free of charge, in the exact same format as you receive it. You may NOT charge a fee for this.

2. You MUST state clearly when redistributing this SOFTWARE that GBS is the sole owner, and retains all ownership rights.

3. You may NOT redistribute any individual file from the setup package. Only the setup package in its entirety may be redistributed.

4. You may NOT disassemble, decompile, or otherwise manipulate the SOFTWARE binary for any reason.

III. WARRANTY DISCLAIMER

1. This SOFTWARE is supplied as-is, with no guarantees either expressed or implied. No claims are made as to merchantability of either this SOFTWARE or any design/intellectual property designed within it.

2. GBS does not warrant that the SOFTWARE is error-free or will operate without interruption.

IV. LIMITATION OF LIABILITY

1. GBS shall NOT be liable to you or any third party for any indirect, incidental, special, punitive, cover or consequential damages (including, but not limited to, damages for the inability to use equipment or access data, loss of business, loss of profits, business interruption or the like), arising out of the use of or defect of, the SOFTWARE and based on any theory of liability including breach of contract, breach of warranty, tort (including negligence), product liability or otherwise.
